UPDATED: Kelley resignation final, council to wait on replacement

Former Magnolia City Administrator Ryan Kelley’s resignation has been confirmed as final and the city council will wait until after the May 8 election to fill the vacant position.

Following his arrest and subsequent misdemeanor B charge of Driving While Intoxicated on April 17, Kelley verbally resigned to Mayor Jimmy Thornton in executive session during an April 22 council meeting called to discuss Kelley’s employment.

When the council reconvened into regular session, councilman John Bramlett made a motion to accept his resignation “effective immediately,” which was seconded and then unanimously accepted by council members.

City attorney Leonard Schneider confirmed that the council’s acceptance of Kelley’s resignation was final, and Kelley is no longer employed with the city.

Kelley submitted a written resignation letter to the city on April 26 requesting that his resignation not be made effective until May 10, however, since the council already accepted his resignation on April 22 and took no additional action at an April 26 meeting, the request was not met, said Schneider.

Finance clerk Beverly Standley confirmed that Kelley is no longer on the city's payroll and has not been since his resignation was accepted April 22.

Councilman Todd Kana stated after the April 22 meeting that it wouldn’t be fair to fill the vacant position before the election due to the possibility that some candidates running may want to eliminate the office of city administrator. Kana, who is running for mayor, added that it wouldn’t be fair to hire someone for the job if it was possible they could lose it after the election.

At a special meeting April 26, the council tabled an agenda item to discuss and possibly appoint an interim city administrator.
