| Magnolia Ridge developers sued for second time in a month |

Magnolia Ridge developers have been sued for the second time in a month, this time by a local surveying company.
The lawsuit was filed Aug. 17 by Woodlands attorney Eric Yollick in the 410th state District Court of Judge K. Michael Mayes. Magnolia-Tex Acquisition Company, L.L.C. and Chaskiel Strulovitch are listed as the defendants in the case. Yollick did not comment on the suit do to its pending status. Magnolia Ridge Development, L.L.C., (MRD) based in Houston, bought the 500-acre community development from Magnolia-Tex last year. According to the petition, Town and Country Surveyors L.L.C., a limited liability company based in Montgomery County, is suing Magnolia-Tex and Strulovitch for nearly $60,000 they say they are owed. The surveying firm is suing for full payment of interest and outstanding principal on a matured note for $59,166.40, according to the suit. The note was executed by Magnolia-Tex and Strulovitch on May 7, 2009. In addition, the suit claims Strulovitch and Magnolia-Tex “never intended” to pay back the money. Aaron Polatsek, who is listed in the suit as a “registered agent” of Magnolia-Tex and is currently a developer with MRD, said the suit “has nothing to do with Magnolia Ridge Development” and is only concerned with former owners Magnolia-Tex. “Since we (MRD) took over we have used their services and paid them for their services,” he said. “We pay all our bills.” This marks the second lawsuit this month for developers of the neighborhood, who earlier this month were sued by a former marketing firm formerly employed by Magnolia Ridge. Paul Lazzaro, of Paul Lazzaro and Associates, filed a lawsuit against MRD on Aug. 10, claiming the owners have continued using the firm’s copyrighted materials after the project was sold to new owners. Lazzaro said he sued after letter he sent to Magnolia Ridge Development, LLC “decrying the misappropriation of his creative and copyrighted materials” was ignored. The master-planned community, located off FM 1488 in Magnolia, has been in the works for several years, enduring ownership changes and setbacks, but recently homes have begun to be built.
