Fagan latest to fall under TEC investigation

Tomball Mayor Gretchen Fagan is the latest local elected official to fall under the watchful eye of campaign finance analyzers after a Conroe resident filed a complaint with the Texas Ethics Commission (TEC) earlier this month.

 

Jim Doyle of Conroe filed a complaint on Sept. 2 with the TEC, claiming that, among other allegations, Fagan accepted a contribution from a corporation and failed to report the required information on campaign finance reports dating back to 2007.

 

Fagan said she received notice from the TEC on Sept. 13 about the complaint. She has 25 days from that date to respond to the allegations.

 

The most serious allegation Doyle claims is that Fagan, on two occasions, accepted in-kind contributions from a corporation, Kwik Copy International Center for Entrepreneurial Development.

 

Doyle states in a report to the TEC that Fagan’s report of an in-kind contribution on May 2, 2007 from Kwik Kopy for $910.92 for brochures, post cards, printing and mailing violated Texas law. Elected officials and those running for political office are not allowed to take contributions from corporations.

 

However, Fagan said that the report was not improper and that she expects the TEC to dismiss the claim.

 

“What I was told by the TEC is that’s not even being addressed,” she said. “He (Doyle) is trying to say on my current report that I accepted contributions from a corporation. That’s not true.”

 

Doyle cites six reports Fagan filed with the City of Tomball during her campaigns for Mayor in 2007 and again for her re-election bid earlier this year.

 

Most of the alleged violations Doyle claims include what he perceives to be inadequate or improper “purposes of payment” on several expenditures made by Fagan, as well as incorrect “contribution balances” on some reports.

 

For example, Doyle states that on Fagan’s April 8, 2010 8th Day Report, the correct total should be $1,622.74, not $1,922.74, after adjusting for a $300 in-kind contribution.

 

However, Doyle said that he may not have taken into account the $300 contribution when coming up with his report.

 

He also cites on numerous instances where Fagan’s “purpose of payment” on political expenditures was not adequate. Specifically, Doyle lists several purchases from Klein’s for which Fagan explained she was buying M&M candies.

 

For this past council election, Fagan and Rick Brown aligned themselves with one another in their campaigns. Brown is the head pastor at ChristBridge Church in Tomball. The M&Ms were handed out to local voters and used to promote a vote for the “Mayor and the Minister.”

 

Doyle states in his report that Fagan “failed to fully disclose the name or address of person receiving a political expenditure” on a June 21, 2020 payment for $31.18 to TEAM.

 

However, Fagan’s report included the proper address and the common name for which Tomball Emergency Assistance Ministries is referred to.

 

“They’re questioning that I made that donation,” Fagan said. “Well, the guy’s not from Tomball, he doesn’t know what TEAM is. Do I need to write a three paragraph explanation or do I need to say it’s a local charity?”

 

“It might be just the way it was written” Doyle explained, when asked about the “purposes of payment” explanations.

 

“These things have to be itemized when they put them on the report,” he added. “They have to include the address, everything. Some of those things were just not filled out completely.”

 

One discrepancy Doyle cites is an April 1, 2010 payment to the Tribune for which Doyle says Fagan did not disclose the purpose of the expenditure. Fagan’s April 8 report does list a $37 payment to the Tribune, but not a purpose for the payment.

 

Tribune financial records show Pat Bailey, Fagan’s mother and campaign manager, purchased two retail advertisements for the campaign to run in the Tribune on April 5 for $18.50 each.

 

The TEC cannot comment publicly on open investigations. Fagan faces fines of up to $5,000 per violation.

 

She believes, however, the Commission will find nothing improper.

 

“The financial information is all accurate and I will answer those allegations to the Commission,” she said. “The other issues are so minor as to be laughable.  M&M’s are M&M’s, not trying to hide anything there. I donated my left over campaign funds to TEAM, everyone in Tomball knows what that is. Tomball reports are not filed with the state only with the City Secretary (Doris Speer) and I am pretty sure she knows TEAM, Klein’s and M&M’s.”

I have seen copies of the three Treasurer appointment forms that a Gretchen Cox and A Gretchen Fagan has signed. Just above the signature it is clearly stated: "I am aware of the restrictions in Title 15 of the Election Code on contributions from corporations and labor organizations." I have al seen campaign reports that were filed with the Ethics complain and also sent to the Harris County DA that have in what appears to be her own hand writing a clear Inkind Contribution from a company with the letters: "Inc." clearly printed. Upon further research at the SOS and Texas Comptrollers office this company indeed was an operating Corporation in the State of Texas as the time that Gretchen Fagan signed a campaign report (under the penalty of perjury). In Title 15 of the Texas Government code it is also clearly stated that this is a Third Degree Felony..... there is no lesser offense or way out of this one..... Texas has some interesting Womens facilities, and it ain't no Martha Stewart facility either. The most recent apparent other corporate twist is known quite well in the political world where a service or products are bought, and then funds returned, thus creating a corporate contribution by "laundry" method. Most juries see right through this one, and many experienced Defense attorney can tell you this too.... Political corruption is on the radar screen of more people now than even in 1980 when we got rid of Jimmy Carter. I really don't see a trial here, as it will just go harder in this mood all over. The real embarra*sment is for Tomball citizens that have worked so hard to make this a real "home town" and the Sanctuary City designation that has been earned by this Mayor and city council is a real tough one to handle right now. It's time to go, game is over.

What is important to remember is that the inquiries by the Texas Ethics Commission into both Gretchen Fagan and Derek Townsend have not concluded, and may not be concluded for several months; there has been no "guilt" proven. Presumed innocent until proven guilty is one of the most important ideals in the American justice system. The only group that can judge right or wrong here is the TEC. We should let the system do its job and take its course through both inquiries before we sentence anyone in the court of public opinion.

Brian, My comment is based upon the facts that were personally and voluntary given by Gretchen and signed (notarized under penalty of perjury) and in her own personal hand writing. This will also be dependent upon the DA as to the felony crimes admitted to under signed and sworn statement, and I really have to wonder how much factual can one get when it is in black and white. Now comes the test of integrity as to this person being a "stand up, do the right thing" and resign or drag the good citizens through the wringer kicking and squirming and looking for loop holes and outs. It reminds me of the speeder caught going 60 mph in the 20 mph school zone and blaming their ticket on the cop that stopped them and then finding every weasel way out possible because they can't take responsibility. Your news article reads more like a defense editorial rather than a fact based findings. How would Tomball operate if we basically ignored a lot of the little things that council has pa*sed as ordinances? Are the cases being dismissed left and right in the City Court? Do we apply the Amendments to the privileged and then to the "little People" in a more harsh and demeaning way? Why don't you publish the filings and reports in their entirety? Why don't you show some of the tricks used by politicians to get money back?

First let me say that the complaints against Fagan and Townsend are totally different. Townsend's complaint was based on a printer making a mistake in printing his signs. Fagan's complaint was based on accepting a corporate contribution which is illegal and carries a third degree felony. I agree with Brian that everyone is innocent until proven guilty; however, if it walks like a duck and it quacks like a duck then it must be a duck. And isn't it ironic that the media doesn't want Fagan to be convicted in the court of public opinon. Where were you righteous ones when Sarah Palin was being convicted in the court of opinon? We didn't hear a peep from you then. It is imperative that we hold our elected officials accountable.
If not the public, then who?

Am I the only one that finds the continued interference of politically motivated outsiders in Tomball business annoying? Every weekend we have to watch Nazi Tea Party Outsiders on one corner confronting Communist Labor Party Outsiders on another...ENOUGH ALREADY BOTH OF YOU! GROW UP!!!

This attack on our councilmembers & mayor by the Republican Party and Tea Party loyalist by any means just doesn't make sense?

Look close and you'll find other names (i.e. Jim Doyle MCRP Precinct Chairman #56) who filed complaints with identical wording against Councilman Townsend & Mayor Fagen.
