Checking Magnolia’s E-mails – September 14

The following are copies of e-mails obtained by the Tribune from an open records request submitted to the City of Magnolia. The e-mails include messages sent and received by City Administrator Ryan Kelley, Mayor Jimmy Thornton and City Councilwoman Patsy Williams. SUBJECT: Dismissal Form

 

I was just made aware of a form distributed today by court personnel entitled “Magnolia Police Department Citation Dismissal Form”. While I have no problem with the concept, I was not consulted with, did not authorize, nor involved in the printing of this form. If the courts want a Dismissal Form shouldn’t it read “Magnolia Municipal Court Request for Dismissal Form”?

I need to take off from work on Friday, June 19, 2009; my daughter has a Dr’s appointment@ 8:30 a.m. Judge Purvis has already signed the Time request but, I was told that I need it to get your approval to take a day off as well.

SUBJECT:  city marshal

 

Yesterday I spoke with Robert DeGroot in Rowlett, Texas, the vice president of the Texas Marshal Association, who told me there was no statutory law saying who a city marshal must report to. Robert said a city marshal can report to:  the  judge, police chief or someone in the chain of command of the police department; the city manager or the mayor. Robert said he is assigned to the police department.

 

I called Mr. DeGroot because I was requested to research this issue.

Yes, CitizenCane, Paul Michna has wanted the City Marshal under his wing ever since he took over as Chief of Magnolia. I have several emails that I personally received and saved that were sent through city email.

Here however in reference to him not being consulted in regards to citations being dismissed and his Officer's having to sign off on a sheet that clearly says, "MPD Dismissal Form", they were printed off in the court .. it was the officer's that were requested to dismiss the citations, not the court. The Court clerks nor the prior City Marshal had this authority... This was discussed both with him and Lt. Crabtree.

Robert DeGroot, the VP for the Texas Marshal's a*sociation in a fantastic person. He joined the a*sociation almost two years ago and this past year we ellected him as VP. He's an excellent instructor. If I wanted information however I would have contacted the President of TMA or Andy Kersterns. Robert has no clue as to how to set up or the guide lines to do so and the one's with the a*sociation have been there so long that they have guided other agencies through the years. I myself helped several agencies and still do or put them in contact. There is a slide presentation that is shown to Councle and it's perfect.

The position for City Marshal in Magnolia however was set up with it's own ORI number and does not fall under the Police Department period. Paul Rex fought this position from the beginning. The Chain of command that is in the ordinance states: The City Marshal answers to the Judge. Robert works through his Police Department because they wanted one when it was set up. If you need to reseach Chief Michna, check with City Hall, they have all of the paper work and would be glad to share it with you. TMA also has a new President, he's great but would have you contact Tommy White for answers or one of the board that has been around longer.

I guess the Judge is no longer a department head over his people, I wonder does an officer also have to get Kelley’s approval when taking off?
