The following are copies of e-mails obtained by the Tribune from an open records request submitted to the City of Magnolia. The e-mails include messages sent and received by City Administrator Ryan Kelley, Mayor Jimmy Thornton, City Secretary Debra Brent and City Councilwoman Patsy Williams. SUBJECT: TexaSure Financial Responsibility Program

In spite of the legal opinion by District Attorney, Brett Ligon, Judge Purvis still refuses to accept citations for No Insurance unless there was other probable cause to stop the vehicle. I have tried to keep you informed, furnishing you with the written correspondence. Do I have authorization to speak to the city attorney to determine what recourse I have? Can the Mayor review the issue and make a determination?

It is my belief the Judge has exceeded his authority when he says he won’t accept these citations saying the officer lacked probable cause for the stop. That shouldn’t be an issue unless the citation is argued in court and that becomes a defense.Everyone thought the legal opinion would resolve the issue-it hasn’t.

Leonard,

I followed up with the Education Center and spoke with Ryan Turner who said he knows you. I explained the Judge’s refusal to accept citations for No Proof of Financial Responsibility when the data from TexasSure is used as the “reasonable suspicion” to stop the vehicle. Ryan Turner was very familiar with the program and said he would like a call from you.

 

I’ll let him tell you what he thought of the judge’s actions.

That State Comptroller’s office is holding a couple of items as “unclaimed property” for your city, and it’s departments. These items are listed in the Comptroller’s database as followed:

 

“City of Magnolia” – 1 prop. Worth $620.05

“Magnolia Police Dept” – 1 prop. Worth $40.00

Please claim ALL of these funds, and use them to service your community. Call the Comptroller at 1-800-654-3463 for the official claim forms, or claim them online at the Comptroller’s official website listed here https//txcpa.cpa.state.tx.us.

In addition, there are other items listed for your local fire department. Please make sure these are claimed also.

Ryan, I left you a voice message a moment ago concerning the proofs for the Magnolia Code. We really do need to get the changes back so we can move forward with this project and get you a new code by the end of the year. As you recall, I sent you a set of proofs and detailed instructions on how to review them back in January, and have contacted you several times since then. I know how busy things get for City Administrators, so please let me know if we can help in any way.

Thanks Ryan. I look forward to hearing from you and to working with you as we move towards final completion of this important codification.

Only been trying to get those proofs completed since the first day Mr. Kelley came to work for Magnolia.
Maybe that can be his new year's resolution.
