The following are copies of documents and e-mails obtained by the Tribune from an open records request submitted to the City of Magnolia. The e-mails include messages sent and received by City Administrator Ryan Kelley, Mayor Jimmy Thornton, City Secretary Debra Brent and City Council member Patsy Williams. Looks like the additional fencing cost for the back would be about $1740 and the side about $870 for a total of $2610. Let me know if you think we should go ahead and ask the Board for the full amount at this month’s meeting.

The City Council has authorized me to retain you for limited research (hour or so) to assist in identifying issues involve with City Impact Fee Ordinance and the waiver of an impact fee for a residential irrigation meter to water lawn (alternatively the amendment of the impact fee ordinance to waive impact fees for residential irrigation meters to water lawns).

Debra has the documents presented by the person requesting the waiver. Attached is a copy of the impact fee ordinance.

Leonard,

Impact fees are calculated by the city’s consulting engineers to recover the proportionate demand each future service unit will put on the water system. Although irrigation meters have a different time of usage, their overall impact on a water system is equal to or greater than the potable domestic water usage in the house.

To waive the impact fee the city would need to make findings that the irrigation meter class is not presenting a demand, which I do not believe can be done with your current impact fee demand study. To create the waiver, you need the engineers to amend the study if they can.

I do not see how a waiver is possible under the current ordinance.

I have gone on record time and time again stating that an irrigation meter causes larger impact on a water system than a typical residential connection. Where is the idea coming from that irrigation meters should get special treatment or a break? If the council wants to give them a break for some reason, then I guess it can be done, but there is no technical defense for giving irrigation meters special treatment.

Interesting that Mr. Kelley only forwarded the impact fee emails to the Mayor and Williams. This issue seems to be very important considering two lawyers and an engineer are involved. Why wasn't the other members of council sent the same information as the Mayor and Williams?

I agree. Shouldnt our whole council be included in important items like this? Maybe if ALL members were notified about ALL things they might be more involved and can help with some of the existing problems. I wonder if they know they are being left out of the many loops? One meeting a month may not be enough to get the whole council involved.

Seems this is nothing new, Ryan only answers to the Mayor and Williams.
John Bramlett has tried, I honestly believe that Kana would have if he would ever have received the info. As far as Sanders he wouldn't have cared, Sammy has let a lot of folks down from all walks of life. www.savemagnolia.net

Kana's investigation skills are lacking. A decent investigation would have revealed the truth to him and he may have made different decisions. That's too bad for Magnolia, he was once a good councilman.
