Judge put on leave as city makes big cuts

Magnolia Municipal Judge John Purvis is on paid administrative leave and two Magnolia Police Department employees were left without jobs after the Magnolia City Council voted to cut the positions in an effort to save money.

Faced with a six-figure deficit, the council held executive session personnel evaluations and made several amendments to the city’s budget at a Feb. 27 meeting.

The council voted to put Purvis on leave due to findings revealed in his evaluation, which he requested to be made public.

Margaret Robbins, of Hardin and Robbins consulting firm, who has been evaluating and working with the court and its clerks since November, spoke throughout the majority of the evaluation.

Robbins went over several reports she filed and highlighted the problems the court had before she began working to correct the problems.

The issues brought up included complaints not being sworn in, improper dismissal of court cases, signed and uncompleted judgments for capias pro fines (a type of warrant) improper collection of court costs, subpoenas being issued instead of summons to notify defendants of charges filed and outdated or incorrect forms used.

One of the major problems she discussed was the court’s processes regarding hot checks.

Robbins found that the court had more than 800 cases filed of issues of bad checks and none had sworn complaints.

“That means the court had no authority to take any money or order any restitution from any defendant,” Robbins said. “That also means that this is a great injustice to the merchants in this city because these cases were not handled properly.”

She estimated there was more than $130,000 in fine money collected that the court had “no authority” to collect and would have to return.

“The bottom line is, if the city has no authority to collect any type of money, then you can’t keep it,” Robbins said. “You have to give it to the unclaimed property division of the state.”

City attorney Leonard Schneider clarified that the city will have three years to find the individuals to reimburse them. It also gives the city three years to raise money as well.

After three years, the money will have to be returned to the state comptroller’s office.

When questioned by the council, Purvis said he wasn’t aware that procedures and processes were being done incorrectly.

“The things that I haven’t done, is truthfully, simply from ignorance,” Purvis said. “None of us know all of it all, I don’t care who it is. You just can’t know everything. That’s fine. I accept it, all the wrongs that I did.”

Purvis, who said he has been a judge for more than 35 years, served 28 of those years for the city of Magnolia.

“I’m sorry this has come to this type of situation,” he said during his evaluation. “Whatever things are wrong, I take full responsibility. Court clerks have no responsibility for this.”

Later in the meeting, the council voted to cut two positions from the police department; one police officer and one police department clerk.

Along with reductions in the police department, they voted to reduce the court staff from three full-time clerks to two full-time and one part-time clerk and eliminated night court.

The council also discussed moving to a four-day work week at city hall and moving to centralized purchasing of supplies.

Lets see the powers to be, you know, the special people (Council and Mayor) have done an audit for the police department and now one for the courts both revealed some interesting findings.

But if the citizens really want to know the bottom line you may want to start a petition to have a Forensic Audit down at CITY HALL. If the election should bring in new blood it would be in your best interest to have one done and get started on the right foot.

This would reveal just how bad things really are and would also show how those special people used the tax payers money and why we are in the shape we are in.

I can a*sure you if a Forensic Audit was done you would not need an election, but one would say I didn't know "I am just a woman".

That's what I would do give the administration three days off, that might keep them from spending for an extra day. They should be working around the clock and for free after their eight hours or ten hours if you go to a four day work week to get the City back on it's feet.


Maybe all spending should be stopped and all collections be made and quit giving back money. Stop paying extra for leagal advise and severacne pay, law suits. Maybe instead of cutting employees you reduce their pay starting with the Police Department. Sorry but for a city this size they are over paid, and you have Thornton and Williams to thank for that. Just check other small cities pay scale in the area's.

This council has the gall to judge others? The Judge admitted there were mistakes, that is far more than any of the elected officials have done. This council has a city administrator that has been caught in many lies as well as being proven that he can't oversee the daily operations of the city but yet this council supports him 100%. That says it all Magnolia, you are governed by people that would rather support dishonest unqualified people instead of doing what is right for the city.

If I see a Magnolia trying to pull me over for anything....I'm calling the DPS or Texas Rangers for a second opinion. I say sue the City of Magnolia right out of business and let the sewer go back to the County for services. I am tired of paying taxes for this poorly run and dangerous little podunt government of fools.

All i have to say is I grew up in magnolia, I still remember when Don Cameron was the local dps officer. When I started driving I had to drive with one hand on the steering wheel and one hand out the window waving,because you pretty much knew everybody now I can go months without seeing anybody I know. Its SO IN MY OPINION IF YOU DONT LIKE HOW WE DO THINGS IN MAGNOLIA THEN TO PUT IT WHERE YOU CAN UNDERSTAND IT "JUST LEAVE AND TAKE EVERYTHING IN ONE LOAD SO YOU DONT HAVE TO COME BACK " thank you
