Magnolia Stroll facing property, utility line issues prior to completion

Property boundary issues have come to light as the Magnolia 4A Economic Development Corporation prepares to unveil a completed Magnolia Stroll to city residents next month.

 

A land encroachment dispute arose recently when a survey paid for by council candidate Dave Sutherland found that a section of the Stroll encroaches on property he owns on Clepper Street near Sullivan Park.

 

“It really looks like they encroached on our property,” Sutherland said. 

 

According to the results of the survey, a portion of the Stroll extends onto his property in one area by 6 inches and on another by 8 inches.

 

Sutherland said he submitted an open records request to the city asking if a survey was done was performed by the city before beginning construction. He said the city responded by saying no survey was done.

 

Sutherland, a former city councilman, also filed an incident report with the Magnolia Police Department last week after a confrontation between he and 4A EDC president Jonny Williams over the property and survey markings.

In the report, Sutherland claimed that on March 12, he was confronted by an angry Williams while standing on his property on Clepper Street while Sutherland spoke with two friends.

 

Sutherland said that Williams’ wife, councilwoman Patsy Williams, took pictures of the survey markers while Jonny Williams “appeared angry” when he approached him and “started with a verbal altercation.”

 

He went on to write that an exchange between he and Williams then took place, where Sutherland claimed Williams used several expletives.

 

The Williams’ left soon after, Sutherland said, and later that day Jonny Williams called and apologized.

 

“I did not do this for any other reason than to find out where my property lines were,” Sutherland said. “The survey came out the way it came out.”

 

Williams admitted that the city may have made a mistake with the property boundaries.

 

“There’s a possibility of there being an error in the layout from the contractor’s point of view or possibly a survey error,” Williams said. “Regardless of which one it is, we will correct our problem. If we have encroached on his property, we will move it, which is not a big deal.”

 

He added that a surveyor for the city and Sutherland’s surveyor were planning to meet last week to “work it out.”

 

In addition to issues with property boundaries, construction crews have experienced rain delays and run into water and gas lines.

 

“It happens,” Williams said.

 

He went on to say that such issues are common during large-scale construction undertakings like Unity Park and the Stroll.

 

Despite the problems, Williams said he has not received negative feedback from business owners along the walkway.

 

“Business owners (along the Stroll) are excited,” he said. “Everybody I’ve spoken to has been positive about it.”

 

The Stroll, a walking trail one block west of FM 1774 that runs south from FM 1488 to Sanders Street at Magnolia Junior High 6th Grade Campus, extends along the back alleyway of downtown businesses along FM 1774.

 

The pathway will feature lamppost lighting, tables and benches and several archways, or arbors.

 

He added that “assuming the rain holds off” all lighting will be installed by the end of the month.

 

“We should be pretty well finished by the middle of April,” Williams said last week.

 

A dedication ceremony for the walkway scheduled for April 24 is currently in the planning stages.

Well I dont and will not understand why the city of Magnolia started this ridiculous "stroll-way" any way.. it is to me,, a waste of money and time, as usual.. lets put money where its not needed.. instead of doing something we all in the city could use... if you can not think of something far better then that..then SAVE it for a really GOOD idea.. when and if that ever happens...

OH and one more thing,every one knows to get a survey done BEFORE digging up ground to make a path thru the back of properties.. you would think that would be the 1st thing done, to insure that this does not happen, showing respect for home and business owners. DUH...

Our family has not been here long in Magnolia, however since we arrived I am amazed at the lack of industry educated personnel that serve this city. From lack of judicial processes that will cost the city money to a 'stroll' that was not properly planned, which could cost the city more money. As stated above, "run into water and gas lines" ....so are we to a*sume you did not have those marked before the digging started? Again, the lack of competent personnel is quite scary~I've driven down the sides streets that cross the 'stroll' and I can't believe the people of Magnolia approved this project. Stroll along a path where you can see weeds, junk cars, chain link fences that are falling down, the backs of poorly kept or rotting buildings! Wow, put that on a brochure would ya?! I am sure it will pull in all kinds of retail dollars for the city merchants.

"Expletives"-Use of profane exclamation, foul language, possible threats? Why is this type of behavior tolerated? Why should Johnny Williams a representative of the City be given a free pa*s? This is the reason people do not speak up or come to meetings or run for office, and that's the way the William(s) want it! its the heavy hand or in this case a foul mouth from Johnny Williams in a fit of rage because he (Williams) did not do his job to begin with. IF you disagree with the William(s) this is the type of reaction you can expect.
Leaders, why would one fly off of the handle like this in a fit of RAGE? Because, he, (Johnny) believes he has the right to treat Citizens this way, he's JOHNNY WILLIAMS. Well Mr. Williams you made an apology to Mr. Sutherland but you also owe an apology to the City (the citizens) for you behavior not only using bad language but almost knocking Patsy down? You need to take an anger managment cla*s and then resign!
Your actions in this matter is very disturbing.

Why was an arbor constructed in the corner portion of the property at Sullivan Park? That doesn't appear to be safe for children. If a child was to run out of the arbor they would more than likely run right into the busy intersection of 1774 and 1488. It only takes a second for a child to make such a dangerous mistake and it could easily happen if a parent has several children to watch while at the park. Whether or not the stroll was a good idea or not is not the concern with this particular arbor location. The concern is the safety of children and it doesn't seem that the park area was very well planned. Which entity is liable for such a dangerous situation? The state that owns the property or the city that constructed the haszardous situation?

Magnolia's such a dumpy looking place. This so called "stroll" is going to be a walk through the alleys and back loading areas of the crappy little businesses that line the easement. I've watched the progress or lack thereof and noted that everything is being done unprofessionally, without proper planning and in an uncoordinated fashion. But that's Magnolia for you. Please wake me up and tell me if this dirty, filthy town ever does anything correctly. I drive through there frequently just for a good laugh. If I lived there I would be sooooo embarrased to admit to live there. Magnolia is Mongolia.
