A Tomball area man was jailed just before Christmas after allegedly firing a BB gun at a man standing near his vehicle.

Deputies with the Harris County Precinct 4 Constable’s Office charged Dominique Levarity, 18, with one count of Deadly Conduct, after Levarity allegedly fired one shot at the man while driving by Dec. 20.

“The complainant stated that he was standing beside his vehicle when he observed a green Ford Explorer approaching him on the roadway,” a constable’s office press release stated. “As the vehicle passed, an unknown male rolled down a passenger window, pointed a handgun at the complainant and fired one shot. The complainant heard the projectile strike an unknown metallic object.”

Deputies say that a witness then followed the vehicle to a church on Kuykendahl and FM 2920. When deputies arrived they found Levarity in possession of a BB pistol.

Levarity was freed on $1,000 bond Dec. 21. He is scheduled to appear before Ninth District Court Judge Analia Wilkerson Jan. 18.
